US ITC officially launches 337 investigation into TOPCon solar cells, modules, panels, modules, etc

On December 4, 2024, the United States International Trade Commission (ITC) voted to approve certain TOPCon solar cells, modules, panels, modules, and downstream products (II) (Certain TOPcon Solar Cells), Modules, Panels, Components There of, and Products Containing Same (II)) initiated a 337 investigation (investigation code: 337-TA-1425). On October 23, 2024, Trina Solar (U.S.), Inc. of Fremont, California, Trina Solar US Manufacturing Module 1, LLC of Wilmer, Texas, and Jiangsu Trina Solar Co., Ltd. of China filed a 337 case investigation application with the U.S. ITC, claiming that the product exported, imported, and sold in the United States violated U.S. Section 337 (infringing U.S. registered patents 9722104 and 10230009), and requested the U.S. ITC to issue a limited exclusion order and injunction. CSI Solar Co., Ltd. of China, Canadian Solar Inc. of Canada, Canadian Solar (USA) Inc. of Walnut Creek, CA, Canadian Solar Manufacturing (Thailand) Co., Ltd. of Thailand, Canadian Solar US Module Manufacturing Corporation of Mesquite, Texas, and Recurrent Energy Development Holdings, LLC of Austin, TX are listed as defendants. The US International Trade Commission will determine the end date of the investigation within 45 days after filing the case. Except in cases where the United States Trade Representative vetoes a relief order based on policy reasons, the relief order issued by the United States International Trade Commission in the 337 case shall take effect from the date of issuance and shall have final effect on the 60th day after the date of issuance.
